and natural persons (hereinafter: “user”, “female user” or “users”) who use services or purchase products through the website https://flintcards.com or the flint platform.

By registering, purchasing a product or using the platform, users declare their agreement to these Terms and Conditions. Diverging conditions of users are not recognized unless we expressly agree to their validity in writing.

§ 2 - Service description

flint offers the following services:

  1. Personalized business cards with QR code (flint Cards): Physical cards printed with the name of the user and an individual QR code. Each card is provided with a unique personal QR code that refers to a digital profile on the flint platform.
  2. Digital profile: Each registered person receives a personal profile on the platform, consisting of first name, age, up to three photos, a bio (max. 300 characters), tags and a stated intention.
  3. QR landing page: Persons who receive a flint Card and scan the QR code (hereinafter: “recipients”) are first informed about the concept of flint and are then directed to the profile of the card-issuing person.
  4. Interaction and matching function: Recipients can optionally signal willingness to make contact. In the event of mutual acceptance, a private in-app chat is enabled. Telephone numbers or other contact details are not exchanged.

flint is expressly not a dating app in the conventional sense and does not constitute a matchmaking service. flint merely provides technical infrastructure to make a first step in real life easier. flint assumes no responsibility for the occurrence or outcome of encounters.

§ 3 - Registration & Account

3.1 Card holders Use of the platform as a card holder requires registration. The following information is required for registration: first name, age, email address, password and at least one photo. The information must be truthful and current.

3.3 Minimum age Registration and use of the platform are permitted only for persons aged 18 and above. By registering, users confirm that they are at least 18 years old. If there is reasonable suspicion of minority, flint is entitled to block or delete the account.

3.4 Account security Users are obliged to keep their access data confidential and to inform flint immediately if unauthorized access to their account becomes known. We assume no liability for actions arising from unauthorized access, provided that such access was not caused by gross negligence on the part of flint.

3.5 No legal claim to registration There is no claim to registration or use of the platform. flint reserves the right to reject registrations without giving reasons.

§ 4 - Prices, payment & delivery

4.1 Prices The following prices apply, including statutory value added tax:

  • One-time card package (10 cards) with permanent app access: € 15.00 total

4.2 Payment Payment is made through the payment service provider Stripe or Mollie. Accepted payment methods: credit card. The full purchase price is charged once upon completion of the order. There are no recurring charges.

4.3 Delivery The personalized flint Cards are shipped after receipt of the order and payment within 8-30 working days to the address provided during registration. Delivery is currently possible exclusively to Austria.

4.4 Personalization & waiver of withdrawal Because flint Cards are personalized goods (name + individual QR code), the statutory right of withdrawal does not apply pursuant to § 18 para. 1 no. 3 FAGG (Distance and Off-Premises Contracts Act). Users expressly confirm this by a separate checkbox during checkout.

§ 5 - Right of withdrawal (FAGG)

5.1 Physical cards For personalized physical products (flint Cards), there is no right of withdrawal pursuant to § 18 para. 1 no. 3 FAGG because these are goods made to customer specifications or clearly tailored to personal needs. Users expressly confirm this during checkout.

5.2 Digital platform service / one-time purchase Users generally have a 14-day right of withdrawal for the digital platform use (profile, chat, QR function). This expires if users expressly agree that flint begins performance before the withdrawal period has expired and at the same time confirm that they thereby lose their right of withdrawal. This consent is obtained during registration.

5.3 Withdrawal instruction For cases not covered by § 5.1 and § 5.2, the following applies: the right of withdrawal can be exercised within 14 days without giving reasons. The period begins with conclusion of the contract. The withdrawal must be addressed to: Caroline Janson, Wolfganggasse 25, 1120 Vienna, Email: caro@flintcards.com

§ 10 - Availability of the platform

10.1 flint strives for the highest possible availability of the platform, but does not guarantee uninterrupted availability. Scheduled maintenance work will be communicated in advance where possible.

10.2 flint is entitled to temporarily restrict or fully discontinue the platform if this is necessary for technical, security-related or economic reasons. Statutory consumer rights remain unaffected.

§ 11 - Changes to the Terms and Conditions

11.1 flint reserves the right to amend these Terms and Conditions at any time. Users will be informed of changes by email at least 14 days before they take effect.

11.2 Users have the right to object to changes within 14 days from receipt of the notification. In the event of objection, flint is entitled to terminate the contractual relationship at the time the new Terms and Conditions take effect.

11.3 If no objection is lodged, the amended Terms and Conditions are deemed accepted. This circumstance will be pointed out separately in the change notification.

§ 12 - Applicable law & place of jurisdiction

12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law referral provisions.

12.2 For consumers, the following applies: insofar as mandatory statutory provisions of the state of residence of the consumer do not conflict with this, Austrian law applies.

12.3 Place of jurisdiction for all disputes arising from this contractual relationship is Vienna, Austria, insofar as mandatory statutory provisions do not establish another place of jurisdiction.

12.4 Online dispute resolution (ODR): The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. Our email address is: caro@flintcards.com. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, but always endeavor to resolve conflicts directly and amicably.

§ 13 - Final provisions

13.1 If individual provisions of these Terms and Conditions are or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.

13.2 flint is entitled to transfer rights and obligations from this contractual relationship to third parties. Users will be informed of this in good time and have the right to terminate the contractual relationship extraordinarily in this case.

13.3 There are no verbal side agreements. Changes and additions to these Terms and Conditions must be in writing, whereby email is sufficient.

13.4 These Terms and Conditions were created on the basis of Austrian consumer protection and e-commerce law. Review by an Austrian lawyer specializing in IT and consumer protection law is expressly recommended before launch.
